HOW CALCONUT, S.L WORKING TO STEAL THEIR SUPPLIER’S MONEY?

CALCONUT, S.L is a company of Spanish nationality.

specializes in trading and distributing cashew nuts.

On September 5, 2023, WE and Calconut signed a contract worth USD 135,125 with an order of cashew nuts deliveried to Valencia port, Spain. During the working process, the parties agreed to choose the D/P payment method.

On September 16, 2023, Calconut provided collection Bank information, specifically:

Due to some signs that Calconut is engaging in fraudulent appropriation of assets, WE has searched all Bank information provided by Calconut and discovered that the tricks Calconut is using are all in the same form:

  • The name of the bank is real,
  • The address and phone number are both fake,
  • The collecting bank representatives are all named Nacho E.C.S Or Virginia Badenes are employees of forwarding companies that are cooperating with Calconut to process customs clearance and carry out import and delivery procedures.

Calconut used this trick to steal the original set of documents, conveniently taking the container out of the port without paying the seller. The above action was successfully carried out on October 19, 2023.

After detecting that the shipment had been stolen without receiving any payment, considering the seriousness of the problem, WE contacted Calconut and the bank they provided many times to request payment but Calconut bank announced that they had not received any information related to this shipment.

These contents were also confirmed by Military Bank – collection bank.

Calconut was very disingenuous when they intentionally sent fake bank information and successfully stole the containers but still insisted that they had not received them. Simultaneously, they required to send a confirmation from Military Bank that the collection had been processed.

At this time, WE still has 3 containers of cashew nuts on their way to Misurata port, Libya with a total value of USD233,136.45, and are also facing the same situation. Noticed that the bank information provided by Calconut was identical to the previously lost shipment. To prevent risks, WE had to ask the shipping company to return 3 containers to Ho Chi Minh, which suffered losses of up to tens of thousands of dollars.

All of this violates current legal regulations as well as international practices and appears to constitute fraudulent appropriation of property. Currently, WE is asking the lawyer’s office to initiate a lawsuit, asking Calconut to pay and compensate for damages caused to related contracts.

Through this incident, WE would like to send a warning to Vietnamese Cashew factories that are and will be doing business with Calconut, S.L to avoid being pushed into a passive position and suffering unnecessary losses.

At the same time, we also list below – the bank information used by Calconut to commit fraud and steal documents so that businesses have a basis for comparison and measures to prevent risks.
