The rules are not exotic — but getting them wrong stops a shipment at the border, and the party accountable for getting them right is the US importer, not the foreign supplier.

FSVP: What It Actually Requires Of The US Importer

The Foreign Supplier Verification Program, under 21 CFR Part 1 Subpart L, places the compliance obligation on the US importer, not the foreign manufacturer. A Qualified Individual must develop and perform these FSVP activities — someone with the training and experience to conduct hazard analysis and evaluate a foreign supplier's food safety compliance appropriately. This can be an employee of the importer, or a qualified third party.

The practical implication: a US buyer sourcing cashew from SVC for the first time needs their own FSVP documentation in place before the first shipment clears customs — not eventually, and not something the exporter can complete on their behalf.

Who Is Named As The FSVP Importer At The Border

At the time of US entry, the FSVP importer must be identified to Customs and Border Protection (CBP) using their Unique Facility Identifier — in practice, a DUNS number. This is a specific, named legal entity responsible for the shipment's FSVP compliance, and it must be correctly declared at entry. An incorrectly identified importer of record is a common and entirely avoidable cause of entry delay.

Where Duty Rates Stand For Vietnamese Cashew Kernels

Following the tariff disruption that affected Vietnamese cashew exports to the US through 2025, duty on shelled cashew kernels has been reduced to 0%.
